Terms of Service

These Terms of Service govern your use of the Heather and Rose Health website and any registration features made available on it. Please read them carefully before using the site.

You must be at least 16 years old to use the Site. If you are under 16, you may use the Site only with the involvement and consent of a parent or legal guardian, who is responsible for your use and compliance with these Terms.


2. Service description

Heather and Rose Health provides informational content focused on best methods and approaches for caring for older adults. The Site may include educational articles, checklists, and general guidance intended to support caregivers and families with everyday planning, communication, comfort, and safety practices. The Site may also offer a registration feature that enables you to create an account for access to updates or additional informational materials.

The Site does not provide medical services, emergency support, diagnosis, treatment, or individual care plans. Any information presented is general in nature and may not be appropriate for every situation. For personal advice, consult qualified professionals.


3. User obligations

You agree to use the Site lawfully and responsibly. When using the Site, you agree that you will:

  • Provide accurate information during registration and keep your account information reasonably up to date.
  • Use the content for personal, non-commercial reference unless we explicitly provide written permission for other use.

7. Limitation of liability

To the maximum extent permitted by law, HEATHER AND ROSE HEALTH LIMITED and its directors, officers, employees, and contractors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or related to your use of, or inability to use, the Site.

To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Site will not exceed the amount you paid to us for use of the Site in the 12 months preceding the event giving rise to the claim, or 100 EUR, whichever is lower.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.


8. Indemnification

You agree to indemnify, defend, and hold harmless HEATHER AND ROSE HEALTH LIMITED and its directors, officers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any law or regulation; or (d) your infringement of any intellectual property or other rights of any third party.

We do not control third-party websites or services and are not responsible for their content, policies, availability, or practices. Your interactions with third parties are between you and the third party and may be governed by their terms and policies.

Our Privacy Policy explains how we collect, use, and share information, including information related to cookies and advertising technologies. The Privacy Policy is incorporated into these Terms by reference.

11. Governing law

These Terms and any dispute or claim arising from or relating to them (including non-contractual disputes or claims) are governed by the laws of England and Wales. The courts of London, England, have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms, subject to any mandatory consumer protection laws that apply to you.


12. Dispute resolution

If a dispute arises, you agree to first contact us and attempt to resolve the matter informally for at least 30 days before filing a claim in court. The informal resolution period begins when you send written notice describing the issue and your requested resolution.

If the dispute is not resolved within 30 days of notice, either party may pursue claims in the courts specified in the Governing Law section above.


13. Termination

We may suspend or terminate your access to the Site or your account at any time if we reasonably believe you have violated these Terms, created risk for the Site or other users, or used the Site in an unlawful or harmful manner. Suspension or termination may occur with or without notice where appropriate.

The following sections survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, and any other provisions that by their nature should survive.


14. Modifications

We may update these Terms from time to time. Changes become effective 14 days after we post the updated Terms on the Site. Your continued use of the Site after the effective date constitutes acceptance of the revised Terms.
